Learning Tools and Questionnaires Will Reduce Workplace Stress, Says HSE

HSE has announced that Ms. Donaldson-Feilder, a researcher, and her colleagues are working on preparing learning tools for managers along with questionnaires for employees, which are guaranteed to reduce stress at the workplace. These questionnaires and tools will be available at the HSE website.

These tools and questionnaires are the result of a research funded by the HSE along with the Chartered Institute of Personnel and Development (CIPD) and Investors in People, which studied the impact of feedback on the management abilities of managers.

According to this research, 150 managers were asked to rate themselves on their managerial abilities. Additionally, 500 employees were asked to rate the management abilities and techniques of their managers. Post the survey; the managers were divided into two groups, where one group was not given any feedback. However, the second group was given feedback on the ratings given by the employees along with relevant training for improving their abilities as well as techniques that can help reduce workplace stress.

According to the researchers, the group that was given feedback went back to work with a changed attitude along with displaying a significant change in their managerial abilities. However, the group that received no feedback went back to work with the same attitude and displayed no change. This led researchers to conclude that change in attitude can be brought about through feedback, ultimately resulting in effective behaviour, which includes,

The ability to communicate work schedules effectively

The ability to empathise with team members

Integrity and ability to manage emotions

Tower Crane Registry Scheme Initiated By HSE

Initiatives have been undertaken by HSE to promote awareness about crane safety levels and to improve confidence of the employers in the use of these equipments in various construction projects. A statutory tower crane register has been proposed as a means to keep track of the use of heavy equipment across sites in the UK.

The HSE Board has come up with this decision after a three-month public consultation. The scheme will be forwarded to Ministers for approval. About 100 responses were received by the safety regulator to this proposal from trades unions, construction contractors and other stakeholders. The scheme will come in force from April 2010 once the approval is received. The deployment of conventional tower cranes on construction sites will be covered by this scheme.

HSE came up with this proposal to address the public concern about the safety of these heavy equipments. The concerns were raised after a number of accidents occurred owing to the use of these equipments. In the period since 2000, eight fatalities have occurred which can be attributed to tower cranes. Of these fatalities, one was of a citizen not directly involved in the construction work.

According to the provisions outlined in the scheme, the employer company using the crane has to ensure that accurate details and notification requirements are fulfilled. These include date of installations, performance checks, intimation of any faults etc. These details will be maintained in a register that will be available for public viewing.

An administration fee of £20 will be charged for registration.

Surprisingly, but after nearly 5 decades the paralegal profession still has no certification requirements. Although not required, certification does offer a competitive advantage to those that have the credentials behind their name. It helps primarily when it comes to securing a job and for that reason and because a high percentage of paralegals coming into the field today are graduates from some either a community college or university; a good percentage of graduates are taking the time to pass one of the many readily available certification tests, shortly after graduation.

Important aspects to keep in mind when analyzing a paralegal program:

1. The central purpose of any high quality paralegal school should be total intellectual maturation of their students. Accomplishing this goal is accomplished by teaching applicable, common sense, usable job skills in addition to a solid core of legal theory. The paralegal programs curriculum must also be broad enough to include subjects ranging from ethics, business organization and torts to legal research and writing. Additionally, the best paralegal degree schools will expend time and effort on developing a well-rounded, critical thinking student with outstanding communication, and organizational skills.

2. Who are players behind the scenes? Who put the paralegal college curriculum together and who is teaching it? Do the staff and the paralegal schools program director have top notch credentials? The paralegal teaching staff should have field experience in the subject they are teaching be considered an “expert” on that subject. The curriculum director should have an advanced degree in a related field at worst but preferably they have a law degree or a bunch of paralegal work experience and an advanced paralegal degree.

3. Distance learning, also called online learning is becoming all the rage but is getting your paralegal degree or paralegal certificate from an online paralegal school right for you? Online learning is clearly different than traditional campus based learning but regardless of how the information is delivered (i.e. interactive video, tele-courses, etc.) the student / teacher interaction isn’t the same. Plus, online learning takes more self-discipline and motivation than campus learning and you have to make the determination that you have what it takes to complete the assignments.

Clearly, pursuing a paralegal career isn’t for everyone but for those that enjoy research, have solid organizational and writing skills and can work under pressure this is a wide open and growing field that can offer financial security and professional satisfaction.

What to Do if You Can’t Pay Your Mortgage in Spain

If you are like many people today, you may be having trouble making ends meet or are living paycheck to paycheck. This often leads to homeowners defaulting on their mortgage, and defaulting on a mortgage for a primary or secondary residence can have serious repercussions for the homeowner. These consequences vary by state, province, and country, so you must be sure to completely understand them.

Defaulting on a Spanish mortgage, for example, has very specific consequences. In the past, such defaulting used to be very simple. This was especially true if the homeowner was not a Spanish citizen and the home was a vacation home or second residence. But now Spanish banks have become more aggressive about enforcing mortgage terms for all homeowners, even non-Spanish citizens.

If you find yourself unable to avoid defaulting on your mortgage in Spain, the bank may agree to take the home back. This simple option will save the homeowner a lot of money in court costs and additional interest on the home loan. But although this is an option, it must first be discussed with the bank. The bank is under no obligation to let you out of the mortgage by taking the home back. Homeowners that have a true hardship as a reason for defaulting on a Spanish mortgage will likely be more successful in negotiating a home turnover. If your spouse dies or your income has dropped due to another cause that is no fault of your own, the bank may consider that a valid hardship and allow you to turn in your keys to the home.

If despite your attempts to negotiate a home turnover, the bank refuses your offer, you must then sell your home. Try to get a final sale price that will cover the remaining amount on your Spanish mortgage or one that will come as close as possible to paying it off, as the bank will still expect the full amount from you in any case. The bank will be most likely to aggressively pursue you for a large shortfall on the Spanish mortgage. However, the bank can legally pursue the homeowner for any shortfall amount at all. This includes placing liens on any assists you may have, such as investment portfolios, your primary residence, and any other property you own that has value. Although it may take years to collect on the shortfall by going through the court systems, the bank that holds your Spanish mortgage will not give up until they do.

Even if defaulting on your Spanish mortgage is inevitable, you should work with the bank as much as possible as soon as you know you must default. Working with the bank that holds your Spanish mortgage can result in a fair settlement that benefits both you and the bank with as little impact on your other assets or financial holdings as possible.

A Great Day of Cat Skiing

Snowcat skiing offers strong-intermediate and expert skiers the ultimate powder snow experience.

Operators provide full-service guided tours into remote high-mountain regions. Powder snow and “fresh tracks” are the norm. Uphill transportation is provided by a tracked snowcat having warm, comfortable cabs. They usually accommodate 12 guests, two guides and a driver.

Some snowcat operators are based in towns or near highways and offer guests continued access to “civilization”. In some cases, guests use local hotels and restaurants for accommodation and meals. Such operators may offer single-day trips.

Other snowcat operators use remote lodges high in the mountains, far from cars and telephones. These lodges provide a multi-day backcountry experience in the midst of pristine alpine wilderness. They also place guests very close to their skiing.

Many backcountry “cat skiing” lodges offer double-occupancy bedrooms complete with private ensuite baths. They have cozy and comfortable sitting areas, dining halls with cathedral ceilings, drying rooms for boots and outside clothing, games rooms, well-stocked bars and “commercial” kitchens. They offer exercise areas, video players, satellite telephones, perhaps a computer with Internet access and, of course, a well-stocked bar. Guests can enjoy a social drink and spectacular views while luxuriating in an outdoor hot tub, and then step right to their bedrooms for a shower or a nap.

No special equipment is required for cat skiing, just boots and clothing. Powder skis can be rented at the lodge. However, snowboarders should bring their own boards. Guests will make the most of their snowcat skiing tour by being in good physical condition.

Lodge life is informal and relaxed. Juice and fruit and coffee are served at 7:00 AM and a buffet breakfast is available at about 7:30. Snowcats depart between 8:30 and 9:00, when guests are ready.

The first day of a tour is special. Guides take the first hour or so to make sure guests understand safety procedures. Everyone has practice using the radio beacons that the operator supplies. No one goes out without one.

The first run of the day is rarely more than 20 minutes from the lodge and the last run of the day can end at the lodge door. During the day, the group moves around, sampling different areas and never staying long in any one spot. Each run is in fresh, untracked snow.

On “bluebird” days, the guide will head for the high alpine. Perhaps for two or three runs on a glacier before trying the big open slopes, taking a run or two in each before heading to the next. The highest skiing elevation can be close to 10,000 ft and the views are spectacular. There is always time to pause for pictures.

If visibility is poor or if the alpine snow is unstable, it’s off to one of the many ridges to “ski the trees”. Tree skiing is amazing! The tree-protected snow is usually deeper and softer than in the alpine. It is consistent, light, and there are no moguls. The short, fat “powder skis” are easy to control. Forget the trees. Just ski the openings! Intermediate skiers who may never before have skied in trees find that they can not only do it, but that it’s fun.

In the old burns, the trees are gnarly, but very widely spaced. The living forest has closer-spaced trees, but offers beautiful glades and tree stands that may have been thinned. Some of the glades are as open as some ski-area runs. The old cut-blocks are great fun. Snow-buried stumps create “pillows”, small mounds to ski around or “pop” off. Landings are nearly always the same, soft and forgiving. It’s amazing!

Guests team up in pairs in the trees and the guide keeps a watchful eye. No one gets separated. When a guest “augers in”, his partner or the tail guide or someone else is close at hand to assist.

The speed of the group depends on it’s ability. A group of good skiers may ski non-stop to the bottom; perhaps 1800 or 2000 ft. of pure joy, with lots of “whoops” and hollers”. Slower groups will stop more often to rest, share experiences, take pictures and “smell the roses”.

Guides are very responsive to the needs of the group. The guests set the pace. There is no pressure to maximize equipment usage. Each group has a dedicated snowcat that moves at the pleasure of the group. Guides are expert at providing for different skiers in their group. Stronger skiers may enjoy some “steeps”, “drop-offs” or other challenges, while others are guided down more “mellow” lines.

By the end of the day, everyone is tired out. Guests who tire early can “sit out” a run and keep the driver company on the way back down the hill. If a guest wants to quit for the day, a staff member will shuttle them back to the lodge on a snowmobile. It’s all very relaxed and very friendly.

Packed lunches are eaten in the snowcats, as guests feel hungry. It’s possible to browse all day on a selection of sandwiches, wraps, cakes, cookies, buns and drinks. “Hip flasks” are definitely NOT welcome. Guides are extremely safety conscious and they want guests to be alert and functioning well at all times.

At 4:00pm, guests are welcomed back at the lodge with special snacks or hot soup. Guests then have over two hours to relax, shower, read, play pool, soak in the hot tub or hold up the bar. Other diversions are possible. Guests might have the opportunity to try out a snowmobile for the first time, to learn how these machines are driven, and to do some exploring.

Dinner is served at about 7:00pm and is of very high quality. Most operators provide gourmet cuisine with extensive wine lists and will carefully cater to guests with allergies and special needs. No one “dresses” for dinner. It’s a relaxed, laid-back and friendly affair. Staff mingles with guests and share tales of the day’s conquests. Amusing speeches and special “award” ceremonies are common. Everyone gets to know one another. There are no “loners”.

After dinner, guests disperse to read, watch a video or to congregate in the bar or games room for some friendly darts or pool. At about 9:30 PM guests start to depart for their beds. The bar usually shuts down by 10:30 PM. Everyone is tired and looking forward to the next day!

Employers Urged to Take Necessary Action to Prevent Slips and Trips at Workplace

Slips and trips are common causes of injuries at workplace and this is largely because safety measures are not in place to prevent them. According to Emma Wiles, Director of Legal Services, Public and Commercial Services (PCS) union, these measures despite being very simple to put up are often ignored by the employers and thus their absence results in accidents and loss of revenue.

In an incident that took place in July 2006, Andrea Swales, a tax credit advisor with HM Revenue and Customs offices, fell down due to a loose carpet tile when she was five months pregnant. She buffered her fall by landing on a seat and hence did not hurt her baby, but it caused a twisting of her back. Attributing the back pain as a pregnancy symptom, she ignored it until it lasted even six months after her delivery. On consulting a doctor, she was told that she required physiotherapy. Her doctor revealed that the main cause of the pain was her fall and that it had brought forward her pain by nine years. Ms Swales has ever since been using physiotherapy and taking steroid injections to alleviate the pain.

Accepting liability and settling the matter out of court, HM Revenue and Customs agreed to pay £9,000 to Ms Swales, who has recently resumed office. However, the question regarding safety of personnel at workplace, especially from slips and trips, still remains unanswered.

Janice Hook of Thompsons Solicitors stated that given the fact that Ms Swales was very vulnerable during the fall, she was really lucky to get out of it unharmed. She went on to state that hopefully HM Revenue and Customs has learnt its lesson from the incident and has put up requisite safety measures in place.
